Yes, it is possible that you may have seen a piece of 3EYES apparel or art before. The Fair use act and collective parody measure protects all copyright holders involved with the inception of ideas and how those ideas are interpreted. Each representation of known images are merely coincidental and not intentional. They are parodies and not an actual representation of the original. These are very short run or one-of-a-kind products, hand made in most cases, made to order almost always and with little profit margin. Please keep that in mind.

What is Trade dress?
Briefly: Trade dress is a trademark law that protects the look and feel of a product and distinguishes it from other similar products. This can include but is not limited to, identifying features such as shape, color, and design of a product or a product's packaging.

What is a copyright?
Briefly: Copyright is a type of intellectual property that protects original works of authorship as soon as an author fixes the work in a tangible form of expression. In copyright law, there are a lot of different types of works, including paintings, photographs, illustrations, musical compositions, sound recordings, computer programs, books, poems, blog posts, movies, architectural works, plays, and so much more!

What is copyright infringement?
Briefly: As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.

What is Fair use?
Briefly: Fair use is a legal doctrine that promotes freedom of expression by permitting the unlicensed use of copyright-protected works in certain circumstances.

What is parody?
Briefly: parody is protected by the First Amendment as a form of expression. However, since parodies rely heavily on the original work, parodists rely on the fair use exception to combat claims of copyright infringement.

What is Royalty-free?
Briefly: in photography and the illustration industry, it refers to a copyright license where the user has the right to use the picture without many restrictions based on one-time payment to the licensor. The user can therefore use the image in several projects without having to purchase any additional licenses. RF licenses can not be given on an exclusive basis. In stock photography, RF is one of the common licenses sometimes contrasted with Rights Managed licenses and often employed in subscription-based or microstock photography business models.

“What does limited run & open series mean?”
• Limited Run: Items produced in a series will be capped at a specific number.
• Open Series: Items will be produced until a time when they are not.

“How do I care for my 3EYES product?”
• Art: Mount in an area where direct sunlight does not shine directly on the purchased piece. Due to the vintage nature of some of the paper items that are used in the construction, yellowing may be already taking place. Further direct sunlight may result in continued yellowing and deterioration. Spray, oil and acrylic paint may be incorporated into your particular piece. Please be aware of the light fast properties involved with paint and how it reacts to direct and in-direct sun light.
• Clothing: Wash all garments in cold water, dry on low heat and iron as needed.

Shipping & Handling:
“How will my 3EYES merchandise be sent?”
• All orders will be sent through the United States Postal Service at the current market rate.
• Tracking in most case will not be provided
• Shipping costs are included in the over-all cost of each item sold
• Items over $300 or more will be insured.
• In some unique cases hand deliveries will be made

“Where’s my stuff?”
• All orders will be shipped on the last business day of each month. Every effort will be made to place purchased items in to the mail as fast as possible. Let’s be real, lets’s be honest life happens. If you want to receive your item(s) quicker, special arrangements can be made and the appropriate shipping cost will be at the expense of the purchaser.
• In some unique cases hand deliveries will be made

“Why did I not receive any extra goodies with my order this time?”
• Every effort will be made to add extra value to the order and make your experience a memorable one. Please remember that these items are on a first come, first serve basis. Everyone is treaded the same. ~ Apologies in advance

Returns • Condition • Repairs • Replacements:
•All 3EYES merchandise including apparel, accessories and original art including prints are sold in an as-is condition. Rest assured that every step will be taken so that you will receive your 3EYES product(s) in the best condition possible. Before, during and after the shipping process. Every item sold will come packed in bubble wrap (if need be) and boxed accordingly. Every shirt will come sealed for freshness and packed accordingly.
